Lawyers’ Fees

Fees for a residential real estate lawyer to act for you in the purchase of your residential property may range in price from $600 to $1,300 in Toronto, Ontario.  The quoted price for the lawyer’s work may include the title insurance premium for the residential property that you are purchasing.  If the cost of title insurance is not quoted separately from the lawyer's fees, be sure to clarify with the lawyer whether the amount of the lawyer's fees includes title insurance.

 

Title Insurance

Title insurance is a form of insurance which protects you against any defects on the title of the property that you have  purchased.  Such defects on the title of the property may include someone else owning an interest in the property, existing liens against the property, and violations of municipal zoning by-laws, to name a few.  Before you are issued the title insurance policy, your residential real estate lawyer will provide a legal opinion to a title insurer.  The title insurance premium will be paid on closing to your lawyer who will then forward the premium to the title insurer.


Purchasing a Condo

If you are purchasing a condo, keep in mind that, in addition to your individual unit, you are agreeing to abide by the rules established by the condo corporation.  The condo rules are set by the condo board to ensure that common spaces and other residents are respected.  The condo rules may include restrictions on noise at certain hours, the number and size of pets, and how your parking space can be used, to name a few.  Before completing your purchase, your residential real estate lawyer will need to review the condo rules to identify and inform you of any unusual or restrictive rules so that you can decide whether you can live with such restrictions.
